Shri Pawan K. Sharma, hereinafter called the appellant, has filed the present appeal dated 22.3.2013 before the Commission against the respondent Institute of Chartered Accountants of India (ICAI), New Delhi for not providing information in response to his RTI-application dated 22.12.2012. The appellant was absent whereas the respondent were represented by Ms. Seema Gerotra, Deputy Director/ CPIO and Shri N.P. Singh, Sr. Joint Secretary/FAA.

The appellant through his RTI application dated 22.12.2012 sought information on the mandatorily earned ‘Continuing Professional Education’ (CPE) hours credits as to why the 6 CPE hours credits have not been given to him on its records despite having attended the programme in question and also what action being contemplated on the erring person. The CPIO vide his letter No. ICAI: RTIA: CPIO: 2312:2012 dated 23.1.2013 informed the appellant that as per records, his name was not appearing in the attendance list of the Training Programme for Technical Reviewers held on 3.9.2012.
3. However, aggrieved with reply of the CPIO, the appellant filed an appeal on 8.2.2013 before the FAA. The FAA vide order No. 29-CA/RTI/AA-387/2012 dated 13.2.2013 recorded that requisite information has been provided to the appellant by the CPIO. On the point of inspection of relevant records/video recordings of the programme, the FAA held that since the inspection of relevant records/video recordings of the programme was not asked in the initial application dated 22.12.2012, therefore the same cannot be considered at this stage as this appellant cannot travel beyond the subject matter of the initial application.

In his second appeal filed before the Commission the appellant states that the respondent denied information pertaining to evidences of attendance records etc. The CPIO and the FAA have grossly erred, seemingly in a mala fide manner on the false pretexts without producing any proof of what they have maintained.

Having considered the submissions of the parties, the Commission hereby directs the CPIO to provide authenticated photocopies of attendance records for the said Continuing Professional Education (CPE) Programme within two weeks of receipt of this order. The matter is disposed of on the part of the Commission.
