Facts:
1. Appellant submitted RTI application dated 20 February 2013 before the CPIO, Chandigarh Housing Board, Sector9, UT, Chandigarh; seeking information in connection with the Site No. 2759, Sector 56, LBS, Colony Palsora allotted to Shri Paras.
2. Vide CPIO Order dated 20 March 2013, CPIO denied the information sought by the Appellant.
3. Not satisfied by the CPIO’s reply, the Appellant preferred First Appeal to the First Appellate Authority dated 26 March 2013.
4. FAA Order dated 18 April 2013, upheld the decision of the CPIO under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. 5. Being aggrieved and not satisfied by the above response of the Public Authority, the Appellant preferred Second Appeal before the Commission.
6. Matter was heard today. Both parties, as above, appeared in person and made submissions. CPIO submitted that the property for which the information is sought was originally allotted under the Slum Dwellers Rehabilitation Scheme and that there was a ban on resale of this property. Also that the information sought by the appellant pertains to third party and that is not required to be disclosed as per provisions of Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Appellant has quoted order of the Punjab & Haryana High Court in the matter of Civil Revision No. 1051 of 2001 dated 29.1.2006. Para B which quotes the provisions of the RTI Act, 2005 and Sections 6(2) and 2(f) “information” means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force; and 8(1)(4) Respondent has also quoted the order of the State Information Commission, Punjab in A.C. No. 1038 of 2011, dated 30.12.2011 to support his case for disclosure.

7. Both parties have been heard. Commission directs CPIO to take action as per provisions of Section 11 of the Act and after bearing in mind the submissions of the third party to dispose of the matter within three weeks of receipt of the order. As regards the cases cited by the appellant, he has failed to appreciate the provisions of Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Also appellant has erred in applying the provisions of Section 22 The provisions of this Act shall have effect notwithstanding anything inconsistent therewith contained in the Official Secrets Act, 1923 (19 of 1923), and any other law for the time being in force or in any instrument having effect by virtue of any law other than this Act. of the Act which clearly states that in case of inconsistency between the RTI Act and any other law for the time being in force, then it is the RTI Act that will prevail. In this particular case, Commission does not see any such inconsistency as the FAA has denied information under the provisions of 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Accordingly appeal is disposed of.
