Facts
1. The appellant filed an application dated 07.09.2012 under the RTI Act, seeking information regarding the policy for allotting properties to those who had migrated from Pakistan, name of the allottee of a particular property, whether the land allotted can be treated as acquired property by personal earnings, etc. CPIO respondent on 08.10.2012. Appellant filed first appeal before the first appellate authority (FAA) on 02.11.2012. Copy of FAA’s order is not enclosed. Appellant filed this present second appeal on 04.01.2013.
Hearing
2. Appellant and respondent were present before the Commission.
3. Appellant referred to his RTI application and stated that he was seeking information regarding the policy for allotting properties to those who had migrated from Pakistan, name of the allottee of a particular property, whether the land allotted can be treated as acquired property by personal earnings, etc.
4. Appellant stated that he did not receive any reply from the respondent.
5. Respondent stated that point no.
(A) of the RTI application pertained to Ministry of Home Affairs;
on point no (B) no reply was given by the respondent;
on point no. (C) they had informed the appellant that the land was allotted to Shri Bansi Lal;
on point (D) they had to base the response on the guidelines given by the Ministry of Home Affairs; and
point no. (E) was in the form of question and it was not information as per the RTI Act.
Decision
6. Respondent is directed to:
(a) procure the information on point no. (A) of the RTI application and provide it to the appellant;
(b) enable the appellant to inspect the pertinent documents as per the RTI application and provide photocopies;
(c) provide the information to the appellant on point (B) and (D) of the RTI application; and
(d) comply with the above within 30 days of this order.
The appeal is disposed of. Copy of decision be given free of cost to the parties.
