1. The appellant is present for the hearing. The respondent was represented by Shri PK Yadav (CPIO) and Shri Sandeep Singh (Manager).
2. The appellant filed an RTI application dated 7.2.2013 seeking information on (9) points in relation to commercial complex/shopping centre near NTPC, Dadri Gautam Budh Nagar Township. The appellant sought to know how many shopping centres have been constructed so far, name of the shopping centres, if any provision for reservation in the allotment of such shopping centres etc. The CPIO replied vide letter dated 8.4.2013 wherein a point wise reply was provided. However, not satisfied, the appellant filed first appeal on the ground that incomplete information has been provided with respect to point no 4, 6, 8 and 9. The first appellate authority upheld the reply of the CPIO vide its order dated 20.5.2013. The appellant has filed his second appeal in relation to point no. 4,6,8 & 9.
3. During the hearing the CPIO submits that some more information has been provided on the point 4,6,8 & 9 vide letter dated 21.2.2014 and also brought on record reply dated 21.2.2014. During the hearing the respondent submits that with respect to point no 5 & 6 the rules, policy, guidelines, maps, name of shops etc has been provided now as earlier only the figures were provided. With respect to point no. 8 the CPIO submits that the list of the shop allottees was not provided under section 8 (1) (j), however now the list of shop allottees along with their occupation, allotment date, address has been provided now.
4. The Commission is of the view that the complete information was not provided to the appellant at the initial stage and the information was denied to the appellant on evasive grounds. The appellant also states during the hearing that he has not received the said reply dated 21.2.2014 from the CPIO. On perusal, the Commission observes that incomplete documents have been provided to the appellant. At point no. 9, the information in relation to kiosks has not been provided till date. The Commission hereby directs the CPIO to provide complete and comprehensive reply to the appellant free of cost within ten days from the receipt of this order. Further, a show cause notice shall be issued to the CPIO separately for providing incorrect and incomplete information to the appellant without any substantial grounds. The appeal is disposed off accordingly.
