Disclosure of documents regarding license issued by IRDA to Max Life Insurance /SBI Insurance
19 May, 2013The appellant filed an application under the Right to Information (RTI) Act with the Insurance Regulatory and Development Agency (IRDA) seeking records pertaining to State Bank of India (SBI) General/ Max Life Insurance/ Apollo Munich Health Insurance Company Limited to act as Insurer. He sought all the documents right from the point of submitting application to acquiring license to conduct non-life business. The Public Information Officer (PIO) denied the information under section 8(1)(e) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; of the RTI Act.

The Central Information Commission (CIC) agreed with the contentions of the PIO and held that the information sought by the appellant is exempt from disclosure under section 8(1)(d) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm the competitive position of a third party, unless the competent authority is satisfied that larger public interest warrants the disclosure of such information; and section 8(1)(e) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; of the RTI Act.
