An application was filed with the Energy Department of Tamil Nadu under the Right to Information (RTI) Act seeking to get information regarding how the Solar Power Scheme was being implemented across the state. The application also sought to know about the details of the subsidy granted by the central and the state government.
As the information was not provided by the public information officer, energy department within the stipulated 30 day time, the applicant approached the first appellate authority (FAA). However, when the FAA too failed to furnish the requested information, the appellant filed the second appeal with the Tamil Nadu Information Commission.
The state information commission has ordered to furnish the information to the appellant within 15 days and has warned the PIO of monetary penalty and departmental proceedings for flouting with the RTI Act by withholding the information for over one year and nine months. In this respect, the commission has issued a show cause notice to the PIO as to why a penalty of Rs. 25,000 be not imposed on him along with initiating departmental proceedings.
