The appellant has sought the following information:
1. What is the period of tenure of Prof. Jancy James as the Vice Chancellor of Central University of Kerala.
2. During the tenure of Prof. Jancy James as VC, How many Show cause memos/ memos were issued to Faculty members.
3. Of the Show cause memos issued by Prof Jancy James to faculty members, how many faculty members belonged to the majority, minority community 2 (Hindu, Christian, Muslim etc). In majority community how many belonged to SC, ST.
4. And other related information.
Grounds for Second Appeal
The CPIO did not provide the desired information.
Submissions made by Appellant and Respondent during Hearing:
The appellant submitted that he is not satisfied with the reply of the CPIO as the desired information has not been provided to him. He further submitted that the CPIO may be directed to provide the total number of show-cause notices issued by the University, if such information is not available in any categorized form as originally sought for in the RTI application. The CPIO submitted that the available information had been provided to the appellant on 14.09.2017. He also stated that there is no categorization done with regard to the show cause notices issued by the University and such collation is also not possible.
Observations:
From a perusal of the relevant case records, it is noted that a proper reply had been provided by the CPIO as per the available records. However, the appellant during the hearing has prayed for a limited relief regarding the total number of show cause notices issued by the University till the date of filing of the RTI application which were issued by the Vice-Chancellor mentioned in the RTI application.
Decision:
Based on the above observations, the CPIO is directed to provide the total number of show cause notices issued by the University during the tenure of the mentioned Vice-Chancellor as per the RTI application upto the date of filing of the RTI application within a period of 20 days from the date of receipt of this order under intimation to the Commission.
The appeal is disposed of accordingly.
