Facts:

1. The appellant, Shri Harinder Dhingra, submitted RTI application dated 23 January 2013 before the Central Public Information Officer (CPIO), Punjab National Bank, New Delhi; seeking information regarding complaint received for failed ATM transaction; reimbursement; compensation paid for such failed transaction etc., through a total of 11 points.

Vide reply dated 28 February 2013, CPIO furnished point wise information except on point nos. 7 & 9 which he had denied u/s 8(1)(e) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; of the RTI Act, 2005. Not satisfied with the CPIO’s reply, the appellant preferred appeal dated 15 April 2013 to the first appellate authority (FAA) saying that he been furnished incomplete information on point nos. 4 & 5 and been denied information on point nos. 7 & 9 u/s 8(1)(e) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; of the RTI Act, 2005. Vide order dated 14 May 2013, FAA upheld the CPIO’s decision on point nos. 7 & 9 and furnished additional information to the appellant on point nos. 4 & 5.

3. Not satisfied with the response of the public authority, the appellant preferred second appeal before the Commission requesting that he should be provided complete information on his RTI application.

4. The matter was heard today. The appellant, Shri Harinder Dhingra, conveyed his inability to join the hearing and requested that the matter may be decided on merits. The respondent, Shri Mohan Singh, Chief Manager was present at the hearing in person.

5. The appellant through his second appeal sought details of the complaints regarding the failed ATM transactions received by the Punjab National Bank including from the card holders from other banks and action taken by the public authority under Reserve Bank of India guidelines.

6. The CPIO submitted that all the information as held by the public authority has been provided including the no. of complaints and the consolidated amount compensated (year wise). The CPIO further added that FAA has clarified in his order that the RBI guidelines, for dealing with the failed ATM transaction complaints are being duly followed by the public authority. Also, instructions issued to the internal auditors by the bank and ‘Review Note’ submitted to the RBI is information held in the fiduciary capacity and this may not be disclosed as per the provisions of Section 8(1)(e) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; of the RTI Act, 2005

7. The Commission upholds the CPIO’s submission that the information as held, has been provided by the public authority.
