ORDER

RTI Application:

1. The appellant filed an RTI application dated 11.12.2012 seeking information regarding the passengers who travelled in the train Maharaja Express dated 17.10.2012, details of staff travelling in the train on 17.10.2012, etc. The CPIO responded on 08.02.2013. The appellant filed first appeal dated nil with the first appellate authority. The FAA responded on 21.05.2013. The appellant filed a second appeal dated 16.07.2013 with the Commission.

Hearing:

2. Appellant and respondent were present before the Commission.

3. Appellant referred to the RTI application and stated that she was seeking information regarding the passengers who travelled in the Maharaja express on 17.10.2012, details of staffs who travelled in the train on 17.10.2012, etc.

5. Appellant stated that the respondent had not complied with the FAA’s order dated 21.05.2013.

Appellant stated that disclosure of the information sought by her would enhance transparency in empanelment of FTO/travel agent/DMC and will eliminate bias or undue advantage to any particular agency. Appellant stated that it is necessary to ascertain the names and designation of the staffs who have been travelling on the train for the given period and to ensure that no unauthorised persons have been misusing the resources of IRCTC by travelling as staff.

8. 9. Respondent stated that by disclosing the names of the DMC/FTO/Travel Agent and names and details of passengers is disclosed, the IRCTC will lose trust. Respondent stated that by disclosing the details of staffs who had worked for IRCTC and had travelled in the train would lead to loss of confidence in IRCTC.

10. Appellant stated that she had sought same nature of information in the matter CIC/AD/A/2012/003879/VS and the Commission vide decision no. CIC/AD/A/2012/003879/VS/6540 dated 17.05.2014 directed the respondent to provide the information sought in the RTI application.

Appellant cited Air India Ltd. & Ors vs. Virender Singh LPA 205/2012 in the context of issuance of complimentary tickets where the High Court observed that information sought by the respondent did not pertain to a third party, rather it pertained to the public authority itself, and the identity of the person to whom the tickets are issued by Air India does not constitute information of commercial confidence. The High Court further observed that the third party procedure prescribed in section 11 of the Act is applicable only for the information supplied by the said thirty party. The beneficiary of the complimentary ticket has not supplied any information and has rather availed of an advantage at public cost.

12.
