Facts
1. Vide this Commission’s order dated 642015, the Commission has ordered as under:“ 3. Complainant has approached the Commission with the prayer for directing Arsha Dharma Parishad to appoint PIO in compliance of RTI Act. Manager of the Society who was present before the commission submitted that he requires 4 weeks time to prepare the reply for the Complaint as the Notice of the commission along with the complaint has to be placed before the Executive Committee of society through the Secretary. He further submitted that the Complainant had not filed RTI application before them, so they did not know as to what information was sought by him. The complaint is posted on 05.05.2015 – 2.30 pm
DECISION:
2. In response to the above notice for rehearing the representative of the Public Authority Dileep Poolakkot, Advocate appeared before the Commission and explained that the Public authority is not a trust, but it is a society registered under the Societies Registration Act. He also submitted that the complainant has also filed a writ in the High Court. He is harassing the public authority in all the ways possible. His grudge against the Society is that he had not been elected to the Society as a member, even though he elected to the society in the past 4 times. He thinks that because of some induction of new members deliberately by the management, he had been defeated. The representative has also submitted that the complainant had neither filed RTI nor FA and he straight away filed a complaint with the Commission. If he had a genuine grievance, he should approach the Registrar of Societies, which he is not doing.
3. Having heard the submissions and perused the record, the Commission considers that the complainant is a disgruntled exmember of the Society who is harassing the society for no reason. Hence the Commission dismisses the complaint.
