Centre likely to contest the SC judgment regarding appointment of information commissioners
16 Sep, 2012The Central government has sought the opinion of the Ministry of Law regarding the possibility of moving the Supreme Court against the judgment in WP(C) No. 210 of 2012, Namit Sharma v. Union of India whereby the division bench of SC had held the Information Commissions were “judicial tribunals” and the job would be “better performed” by a legally qualified and trained mind. The SC ordered that there would be two member benches at the Information Commission.
The Department of Personnel and Training (DoPT) has allegedly raised questions about the SC judgment whereby the appointment of Information Commissioners may be done only after the consultation with the Chief Justice of India.
