The appellant has sought the following information related to letter dated 09/06/2017 addressed to Hon’ble HRD Minister regarding complaint made against KRC Mahila Mahavidualaya Manipur, affiliated to Dr. B.R. Ambedkar University, Agra:
1. Provide the day to day action taken report in regard to above said letter.
2. Provide the name of employees, date of appointment, designation, salary, contact No. who were required to take action in regard to above said letter.
3. And other related information.
Grounds for Second Appeal
The CPIO did not provide the desired information.
Submissions made by Appellant and Respondent during Hearing:
The appellant submitted that he did not receive any relevant information from the CPIO. The CPIO UGC submitted that an appropriate reply was given vide letter dated 09.02.2018 stating that the said complaint dated 09.06.2017 was not received by them.
The CPIO MHRD submitted that the said complaint dated 09.06.2017 was forwarded to UGC vide letter no. F.No.5-4/2017-U.II dated 30.06.2017 and the appellant was informed accordingly on 10.01.2018.
Observations:
Based on a perusal of the record it is noted that both the CPIOs UGC and MHRD have handled the RTI application very poorly. It is pertinent to mention here that both the CPIOs are required to provide information as per the availability of record. Hence, the CPIO MHRD should provide complete notings in respect of the processing of the complaint dated 09.06.2017. Moreover, the CPIO UGC should also re- examine the records and provide the present status of the complaint dated 09.06.2017. In case no action was taken a categorical reply should be provided.
Decision:
In view of the above, both the CPIOs are directed to provide a revised reply as discussed above to the Appellant within 10 days from the date of receipt of this order. A compliance report to this effect shall be sent to the Commission by the CPIOs thereafter.
The appeal is disposed of accordingly.
