14 SMS doctors under investigation for negligence
9 Jun, 2012The Moti Dungari police Station of Jaipur have registered a case for allegedly causing death due to negligence against 14 doctors of Sawai Man Singh (SMS) hospital. Justice Mahesh Chand Sharma of the Rajasthan High court summoned deputy commissioner of police (East) and circle inspector Moti Dungari and asked them to register a case under appropriate sections of IPC. Now, a case of death due to negligence has been registered against 14 doctors of SMS hospital under section 304 A (causing death due to negligence) of IPC including the former Principal of SMS medical college Dr Ashok Pangadia, former Superintendent Dr Narpat Singh, Superintendent Dr LC Sharma and Principal of SMS Medical College Dr. Subash Nepalia.
A patient, Sarthak Jhalani (12), was allegedly declared dead after medication at the hospital on September 18, 2009 for which the victim's father Mahesh Jhalani had initially gone to lodge an FIR against the doctors for wrong diagnosis and medication. Alleging non co-operation by the police, Mahesh approached the Rajasthan High court for justice.
It has been reported that when Mahesh sought the cause of death using the Right to Information (RTI) application from SMS authorities, it was replied that thousands of patients die at the hospital, thus they can't attribute any particular reason behind the case. It raises the question whether the cause of death can be found out in each case and should it be reported to the applicants under the RTI Act?
