Transfer of RTI application to the concerned Public Authority

The appellant sought details regarding provisions for appointment of sportsmen and sons of freedom fighters etc. in Central and State Government services. The Public Information Officer (PIO) replied that the same amounts to seeking legal opinion and was not covered under the definition of “information” as given under section 2 (f) of the RTI Act, 2005. The First Appellate Authority (FAA) also upheld the PIO’s reply.

The Commission observed that information sought by the appellant may be available with the Departments/Ministry dealing with the Government policy on appointment of sportsmen/ sons of freedom fighters. The respondent also concurred that such information may be available with the Department of Personnel & Training or with the Freedom Fighter’s Division of the Ministry of Home Affairs. The Commission directed the CPIO to transfer the RTI application to the concerned Ministry/Departments under section 6 (3) of the RTI Act, 2005.
