Information sought:
The appellant had sought following information about his wife Mrs. Manjusha Amol Vadnere (Employee no. 143377A) working at OFC Department as a TTA. Her date of joining is 10/01/2010 and place of working is Bhiwandi.
1- Latest Salary slip for 03 months (Apr-12 to July -12).
2- Form no. 16 for year 2001-12.
3- Quarter allotment status fills to date. From date of joining.
4- Quarter surrender status/letter (if any).
5- Proof submitted for claiming HRA during the year 2011-12.
6- BSNL employee medi claim policy details-Total coverage and policy card details for present year 12-13.
7- Rent details for Bhiwandi staff quarter as per BSNL Policy.
Grounds for the Second Appeal:
The PIO has wrongly refused the information under section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of the RTI Act.
Relevant Facts emerging during Hearing:
The CPIO stated that some of the information requested by the appellant in his RTI application dated 22/7/2012 relates to the personal information of a lady staff Ms. Manjusha Amol and they had carried out the process as outlined under section 11 of the RTI Act but she has refused to give her consent. He, however, stated that the total remuneration, copies of quarter allotment/surrender letter(s), copy of medical reimbursement rules and the rent details of Bhiwandi staff quarters will be provided. The appellant is not present for canvassing his case/contesting the CPIO’s submissions.
Decision notice:
As stated by the CPIO the information as above should be provided to the appellant within 15 days from the date of receipt of this order. However, copy of form 16 & proof submitted for claiming HRA need not be provided as these form part of income tax return(s) of the employee and is information of personal nature relating to a third party and no public purpose is involved.
The appeal is disposed of accordingly.
