The applicant has sought the following information:
1.0 Refer to Sanction Order No. 3-3/PC-18070/DCRG PO/18258/2013/Pen Dt. 29.05.2013 regarding Payment of Interest on DCRG amount to one Sh. Anil Kumar Jain Ex-SE. I this regard following may be informed/supplied [as attested true copies] and thereafter inspection of concerned file(s) may also please be allowed:
[A] Copy of Notes [i/c Copies of documents/ Descriptive details of documents as referred in the Notes] on file on the basis of which Order Dt. 29/05/2013 have been issued.
[B] Copy of all applicable Governmental instructions/consolidated latest order which allow payment of interest in such eventualities.
[C] Details of period and rate of Interest considered for working out payable interest in this case alongwith interest calculation sheet.
Grounds for the Second Appeal: The CPIO has not provided the desired information.

The appellant stated that the respondent have denied interest for late payment of his DCRG but the benefit has been allowed to Shri Anil Kumar Jain and he wants copy of the order, note sheet and calculation on the basis of which interest was paid. The CPIO’s representative stated that the information relates to a third party. The appellant pointed out that it can be seen from the CPIO’s reply that he has claimed exemption under Section 8(1)(i) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, cabinet papers including records of deliberations of the Council of Ministers, Secretaries and other officers: Provided that the decisions of Council of Ministers, the reasons thereof, and the material on the basis of which the decisions were taken shall be made public after the decision has been taken, and the matter is complete, or over: Provided further that those matters which come under the exemptions specified in this section shall not be disclosed; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, cabinet papers including records of deliberations of the Council of Ministers, Secretaries and other officers: Provided that the decisions of Council of Ministers, the reasons thereof, and the material on the basis of which the decisions were taken shall be made public after the decision has been taken, and the matter is complete, or over: Provided further that those matters which come under the exemptions specified in this section shall not be disclosed; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, cabinet papers including records of deliberations of the Council of Ministers, Secretaries and other officers: Provided that the decisions of Council of Ministers, the reasons thereof, and the material on the basis of which the decisions were taken shall be made public after the decision has been taken, and the matter is complete, or over: Provided further that those matters which come under the exemptions specified in this section shall not be disclosed; of the RTI Act which is not at all applicable. He further argued that even Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. will not apply as he is only asking for copy of official order, note sheet and calculation which is not personal information of the individual. He added that under para (b) he has sought copy of some circulars which should be provided to him. He also pleaded for initiating penal proceedings against the CPIO. He, however, agreed to provide the information.
Decision notice:
As agreed by the CPIO’s representative he should provide copy of the order, note sheet and calculation on the basis of which interest has been paid to Shri Anil Kumar Jain. Further, he should also provide copy of circulars as requested in para (b) of the RTI application. The order should be complied within 21 days from the date of receipt.
As regards the appellant’s plea for initiating penal proceedings against the CPIO, it is seen that the Hon’ble Delhi High Court in its decision dated 01/06/2012, in the matter of Registrar of Companies & Ors. vs. Dharmendra Kumar Garg & Anr. W.P.(C) 11271/2009, while quashing the showcause notice issued by the Commission under Section 20(1) Where the Central Information Commission or the State Information Commission, as the case may be, at the time of deciding any complaint or appeal is of the opinion that the Central Public Information Officer or the State Public Information Officer, as the case may be, has, without any reasonable cause, refused to receive an application for information or has not furnished information within the time specified under sub-section (1) of section 7 or malafidely denied the request for information or knowingly given incorrect, incomplete or misleading information or destroyed information which was the subject of the request or obstructed in any manner in furnishing the information, it shall impose a penalty of two hundred and fifty rupees each day till application is received or information is furnished, so however, the total amount of such penalty shall not exceed twenty-five thousand rupees: Provided that the Central Public Information Officer or the State Public Information Officer, as the case may be, shall be given a reasonable opportunity of being heard before any penalty is imposed on him: Provided further that the burden of proving that he acted reasonably and diligently shall be on the Central Public Information Officer or the State Public Information Officer, as the case may be. of the RTI Act has held as under.
“61. ………………….It can happen that the PIO may genuinely and bonafidely entertain the belief and hold the view that the information sought by the querist cannot be provided for one or the other reasons. Merely because the CIC eventually finds that the view taken by the PIO was not correct, it cannot automatically lead to issuance of a show- cause notice under Section 20 of the RTI Act and the imposition of penalty. The legislature has cautiously provided that only in cases of malafides or unreasonable conduct, i.e., where the PIO, without reasonable cause refuses to receive the application, or provide the information, or knowingly gives incorrect, incomplete or misleading information or destroys the information, that the personal penalty on the PIO can be imposed. This was certainly not one such case. If the CIC starts imposing penalty on the CPIO in every other case, without any justification, it would instill a sense of constant apprehension on those functioning as PIOs in the public authorities and would put undue pressure on them. They would not be able to fulfill their statutory duties under the RTI Act with an independent mind and with objectivity. Such consequence would not auger well for the future development and growth of the regime that the RTI Act seeks to bring in, and may lead to skewed and imbalanced decisions by the PIOs Appellate Authorities and the CIC………...”

From the respondent’s submission it is apparent that the CPIO in this case has not acted in a malafide manner so as to deliberately block the provision of information. Imposition of penalty on the CPIO, therefore, would not be justified. The appeal is disposed of accordingly.
