Ref: Inspection and certified copy of Police Case Diary in relation to a FIR - case is pending trial - as per section 172 of the Criminal Procedure Code, it is a privileged document - the disclosure of copies of case diary may impede the process of prosecution

Comment: In my case, FIR was registered on 22-4-2013 at 10 P.M. Observation mahazar and rough sketch were prepared on 23-4-2013 at 12 Noon and got the sign of Village Administrative Officer with antedate. Police made false entry in case diary that Observation mahazar and rough sketch were prepared on 22-4-2013 at 11 P.M. CrPC 161 statements should be received after FIR. In my case, 161 statements were received before registering FIR. I was arrested before registering FIR. It was not shown in case diary. Magistrates are neither not verifying the correctness of entries in case diary with other supporting documents nor allowed the accused to verify.
