Information related to CRPF Jawans killed during operations

Background
The appellant sought information regarding the CRPF Jawans who were killed since the establishment of CRPF with year-wise details, the name of operations (with name of places where such operations were done) and the number of CRPF Jawans killed. He also wanted to know what remedy and damage were given to the family members of martyrs of CRPF Jawans by Central Government and concerned State Government. The Public Information Officer (PIO) denied the information claiming that CRPF has been given exemption from application of the provisions of the RTI Act, as it is listed in Schedule II. On appeal, the First Appellate Authority (FAA) upheld the same.

The Central Information Commission dismissed the appeal, observing that the CRPF is an exempted organization listed under Schedule II of the RTI Act and therefore, is not amenable to any provision contained in the RTI Act by virtue of Section 24 of the RTI Act. As the information sought by the appellant did not pertain to any violation of human rights or allegations of corruption and therefore, the Commission observed that it does not fall under Proviso (I) to Section 24 of the RTI Act.
