Information related to the annual reports of finance and budget of the MCD mayors

The Appellant wanted the certified copies of the annual reports of finance and budget of the MCD mayors of two wards along with the expenses and the unused amount details of the budget allocated to the two wards. On not receiving any information, the appellant filed the first appeal. The First Appellate Authority (FAA) gave a hearing to the appellant but no information was provided.

The Commission observed that the appellant filed the application with Public Information Officer (PIO), DCA (HQ) Finance & Budget and thus did a reasonable attempt to file it with the right department of MCD who instead of providing the sought information transferred the application to Engineering-in-Chief. Subsequently the application was further transferred to different departments of MCD. All of this shows that the MCD does not have any idea about its own functioning. The appellant was unnecessarily harassed because of the complete ignorance of various MCD officials and was forced to file an appeal and wait for the information. Under section 19(8)(b) In its decision, the Central Information Commission or State Information Commission, as the case may be, has the power to require the public authority to compensate the complainant for any loss or other detriment suffered; of the RTI Act, the Commission awarded a compensation of Rs. 2000/- to the appellant for the loss and detriment suffered by him and directed the PIO to obtain the information sought under section 5(4) within MCD and provide it to the appellant.
