Facts
1. The appellant filed an application dated 16.05.2013 under the RTI Act seeking information regarding the number of occasions that led Delhi police to call Rapid Action Force to manage public gatherings, details of expenditure incurred, details of amount given to the family of a head constable following a certain incident, etc. CPIO responded on 01.07.2013. Appellant filed first appeal with the first appellate authority (FAA) on 03.07.2013. FAA vide order dated 13.08.2013 directed the CPIO to provide a fresh reply. Appellant filed this present appeal on 13.11.2013.
Hearing
2. Respondent was present before the Commission.
3. Respondent referred to the RTI application of the appellant and stated that the appellant was seeking information regarding the number of occasions that led Delhi police to call Rapid Action Force to handle public gathering, details of expenditure incurred, details of amount given to the family of a head constable who had lost his life at the time of performing his duty during an agitation, etc.
4. Respondent stated that they had provided the information which could be given to the appellant under the RTI Act. However, information on point no. 1, 2, and 9 of the RTI application was denied. Respondent stated that the appellant sought information regarding the Rapid Action Force on point 1 and 2 of the RTI application but this was denied under section 8(1)(a) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information, disclosure of which would prejudicially affect the sovereignty and integrity of India, the security, strategic, scientific or economic interests of the State, relation with foreign State or lead to incitement of an offence; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information, disclosure of which would prejudicially affect the sovereignty and integrity of India, the security, strategic, scientific or economic interests of the State, relation with foreign State or lead to incitement of an offence; of the RTI Act. Respondent stated that on point no. 9 of the RTI application the appellant sought information regarding secret fund allotted to Delhi police. This was denied under section 8(1)(a) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information, disclosure of which would prejudicially affect the sovereignty and integrity of India, the security, strategic, scientific or economic interests of the State, relation with foreign State or lead to incitement of an offence; Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information, disclosure of which would prejudicially affect the sovereignty and integrity of India, the security, strategic, scientific or economic interests of the State, relation with foreign State or lead to incitement of an offence; and (g) of the RTI Act.
5. Respondent stated that information regarding the compensation given to a family of a head constable who had expired following a certain incident had already been provided to the appellant. Respondent stated that no further information was to be provided to the appellant.
6. Appellant did not participate in the hearing.
Decision
7. No further action is required to be taken in the matter at the level of the Commission. The appeal is disposed of. Copy of decision be given free of cost to the parties.
