Information regarding lady computer operators who had been promoted as special assistants and posted in the Amritsar during the last two years against the policy of the Bank was denied u/s 8(1)(j) - CIC: provide the information within one week

1. The appellant, Shri Krishan Kumar Batra, submitted RTI application dated 4 December 2012 before the Central Public Information Officer (CPIO), Punjab National Bank, Amritsar; seeking information regarding lady computer operators who had been promoted as special assistants and posted in the city during the last two years against the policy of the Bank.
2. Vide reply dated 31 December 2013, CPIO denied information u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Not satisfied with the CPIO’s reply, the appellant preferred appeal dated 3 January 2013 to the first appellate authority (FAA) saying that he had been wrongly denied the information by the CPIO concerned. Vide order dated 4 February 2013, FAA upheld the CPIO’s decision.
3. Not satisfied with the response of the public authority, the appellant preferred second appeal before the Commission as he had not been given any information by the CPIO as well as by the FAA.
4. The matter was heard today via videoconferencing. The appellant, Shri Krishna Kumar Batra was present at the hearing at Amritsar. The respondent, Shri S.K. Pasreeja, AGM/FAA and Shri Pawan Kohli, CPIO, were present at the hearing and made submissions from Amritsar.
5. The appellant submitted that information had not been provided regarding the number of lady computer operators who had been promoted as special assistants and posted in the city during the last two years.

The CPIO in his submission took the plea that the information sought by the appellant cannot be provided as section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of the RTI Act, 2005 is getting attracted, this being third party information. The Commission directs the CPIO to provide the number of lady computer operators who have been promoted as special assistants and posted in the city during the last two years as the disclosure of the same does not attract section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person.
