This matter pertains to an RTI application dated 18.12.2012 filed by the Appellant, seeking information on five points concerning a loan account. The CPIO responded on 9.2.2013 and denied the information under Section 8 (1) (j) of the RTI Act. Not satisfied with the reply of the CPIO, the Appellant filed an appeal to the First Appellate Authority. In his order dated 28.2.2013, the FAA upheld the CPIO’s reply. The Appellant approached the CIC in second appeal on 8.4.2013.
2. We heard the submissions of the Appellant and the Respondents. The Appellant stated that he was the guarantor of the loan in question and since the loan was not repaid, the bank had recovered its proceeds from his Saving Account with them. He further submitted that in view of the above, he was entitled to the information sought by him. The Respondents acknowledged that the Appellant was the guarantor of the account and offered to provide information in response to points No. 2 and 5 of his RTI application. The Appellant stated that this would serve his purpose. Accordingly, the CPIO is directed to provide information on points No. 2 and 5 of the RTI application dated 18.12.2012 to the Appellant, within fifteen days of the receipt of this order, under intimation to the Commission.
3. With the above direction, the appeal is disposed of.
