Information Sought:
Appellant has stated that he had given one representation dated 20/03/2018 to GM (Admn) regarding measurement of carpet area of Qtr No. 2/1 of Samata CHS, Qtr No. E 18 2/1 of Dream land CHS & of F13 2/1 of Vrindhavan CHS Sanpada Sector – 4.
In regard to the same he has sought the following information:
1. What is the present status of his said representation?
2. Whether any order was issued to Civil Wing/ Estate Wing of MTNL for remeasuring of carpet area of all the quarters in Sanpada area after submission of his representation?
3. If yes, provide a copy of the order issued and & measurement of quarters recorded.
4. And other related information.
Grounds for Second Appeal
The CPIO did not provide the desired information.
Submissions made by Appellant and Respondent during Hearing:
The appellant submitted that he received the recent reply dated 25.05.2021 and is satisfied. The CPIO submitted that a suitable reply was given on 25.05.2021. On a query, regarding the delay he submitted that on February 2021 he joined as CPIO and after receiving the hearing notice, he provided the information. On further query he submitted that Shri H.S Jakhar, was the then CPIO and is now working in BSNL.
Observations:
Based on a perusal of the record, it was noted that the CPIO vide letter dated 02.03.2019 replied that the copy of the representation mentioned was not received in their office, hence no information was provided. The FAA vide order dated 23.04.2019 had directed the CPIO to re-examine and dispose the case within 15 days from the date of receipt of the order. The CPIO vide written submissions dated 25.05.2021 sent a revised point-wise reply to the appellant which was satisfactory. However, the fact remains that the then CPIO failed to comply with the FAA’s order on time.
Decision:
In view of the above observations, a strict warning is issued against the then CPIO for not complying with the FAA’s order on time. The CPIO shall serve a copy of this order to the then CPIO for information. Further, as the appellant is satisfied with the information provided now, hence, no further action lies.
The appeals are disposed of accordingly.
