Now a days it is seen that the people at the CIC or SIC are so-called bureaucrats. Even courts are also one type of this because these are all paid servants.
I have too been asked to provide identity proof by CIC recently. Your clarification in this concern is absolutely simple and logical. I think courts and other authorities are creating unnecessarily complications in this simple RTI Act because it has only to provide available details keeping records up to date but due to deficiency they can't. Instead of admitting mistakes or errors they commit more & more mistakes to harass the peoples because they are hardly punished.
I have also deep experience of non-receipt of information because about 30 to 35 second appeals have been dismissed by CIC, Delhi and SIC, Nasik & Mumbai and asked only to concerned CPIOs to furnish the information. I think this is a caricaturing of RTI Act because then what about time lapsed?
The Government institutions are just imposing rules and regulations on peoples only. These Acts are being implemented not for the sake of people but to safeguard these faulty institutions with flexibility.
However, Delhi High Court has given a decision of J K Mittal & CIC / W.P.(C) No.6755.12 date.28.10.2013 in which the CIC should see whether time limit has been maintained in providing information. If not, penalty should be imposed on such guilty authority and CIC has not any power to send back RTI Act application to CPIO to furnish the details to concerned appellant.
