A favourable decision for appellant and a slap to PIO
7 Dec, 2015
Ref: In its decision No.CIC/SG/A/2012/ 001308/19379, the CIC had directed the MEA to transfer the RTI application to the Indian National Group of Permanent Court of Arbitration for providing information to the appellant - CIC: PCA is not a public authority

Comment: It is really appreciated for being a favourable decision for appellant and a slap to PIO but it is noticed that the CIC did not consider the contempt proceedings / penalties /and 19(8) for detriment or loss. It is noticed cost of living is gone up and charges for correspondence also gone up. It is noticed some Information Commissions are not using RTI provisions18 (3) or sec 20 (1) or (2) despite of prayer in the reliefs. This is what I noticed in our AP SIC/ CIC. No notices are issued against officials who fail to take actions or provide information, perhaps being top officials. It is a poor reflection on how the depts or govt is functioning. This case is good and I am thankful to you. I hope you continue to put some good decisions HC/SC/CIC also.
