Can an applicant obtain a copy of the transfers and postings and the reasons for it? Transfers are not personal information. Transfer and posting orders are administrative orders which should be in the public domain proactively by the public authority. As per section 4(1)(d), a Public Authority is supposed to provide reasons for its administrative or quasi-judicial decisions to affected persons. Furthermore, the section 4(1)(b) (iii) makes it imperative to disclose the procedure followed in the decision making process including channels of supervision and accountability. The public authority should suo-motu disclose the policy followed for the transfer and the reasons for deviation. |
