When can the compensation be claimed?

The claim for compensation has to be linked to any ‘loss or other detriment’ suffered by the complainant in relation to failure to comply with the provisions of the RTI Act. Information Commission does not have power and jurisdiction to decide and adjudicate commercial disputes and award compensation to the applicant under section 19(8)(b) of the Act. The power to award compensation under section 19(8)(b) of  the Act is restricted to cases of loss and detriment suffered by the complainant  for failure of a public authority to comply with the provisions of the RTI Act.
