Disclosure of rules for compulsory retirement of a mentally disabled person

A mentally disable person working as a clerk of the Homeopathy council was compulsorily retired. His wife sought the details of all the instances of nuisances created by her husband and the details of the rules due to which he was made retired by the Council because of his mental disability. The Public Information Officer (PIO) offered an inspection of all the files to the Appellant since the information was available on a large number of files.

The appellant clarified that she would be satisfied if the instances which were relied on for deciding to retire her husband would be provided by the PIO. The Commission directed the PIO to provide attested photocopies of records based on which the decision to compulsory retire the appellant’s husband was being taken.
The PIO was also directed to give the rule which may have been mentioned in any of the deliberations. All the information was to be provided free of cost.
