Information Sought:

The Complainant has sought the following information:

1. Provide the details of all the guest rooms being maintained since 2013 in Officers’ Mess 223 Advance Base Ordnance Depot at Suranussi Military Station (Jalandhar Cantonment) in the following format:

Grounds for filing Complaint

The CPIO did not provide the desired information u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Submissions made by Complainant and Respondent during Hearing:

The complainant in his complaint before the Commission has prayed for directions to be given to the CPIO to provide the required information. For providing incorrect, incomplete and misleading information, penalty and disciplinary action may be taken against the erring officials.

The complainant, however, failed to appear for the hearing despite due service of notice dated 04.08.2021 vide speed post acknowledgment no. ED509196011IN. 

The CPIO reiterated the contents of the reply given on 17.12.2018 wherein the complainant had been informed that the guest rooms are not funded by any public fund and they are run by contribution of posted officers therefore, not having any bearing on any public activity, the information was denied under Sec. 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Observations:

From a perusal of the records available, it is seen that while a reply was given, the blanket denial under Sec. 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. It is seen that some part of the information such as building name, name of the guest rooms, location etc can be provided, whereas the names of the guests who stayed etc has been rightly denied under Sec. 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of the RTI Act.  Moreover, in reply to a later RTI application, some details of the said information was provided by giving an extract of a letter dated 21.02.2019. However, the complainant still holds that this is incomplete information. This complaint is, therefore, being converted to a second appeal as he is desirous of getting the information. The CPIO is accordingly directed to revisit the RTI application and provide a point wise reply to the appellant on all those points which are disclosable, as indicated above.

Decision:

The CPIO is directed to provide the said information to the appellant within 10 days from the date of receipt of this order under intimation to the Commission.

The appeal is disposed of accordingly.
