Grounds for the Second Appeal:
The CPIO has not provided the desired information. Relevant Facts emerging during Hearing: The following were present:-
Appellant: Present through VC.

Appellant stated that he is dissatisfied with the denial of information by the PIO. Rep. of PIO reiterated the denial of information under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Decision
Commission is baffled at the sheer complacency of Lt. Col. JS Brar, PIO in concluding in his written submissions dated 09.01.2019 that the information has been rightly denied by the then PIO without even justifying how disclosure of posting/transfer roster will invade the privacy of third parties. He has merely relied on a decision of this bench in CIC/IARMY/A/2017/176014 to substantiate the denial but has not explained how the said case is relevant to the facts of the instant case. In the earlier matter cited by the PIO, the RTI Applicant had sought for information pertaining to service matters of her husband while in this case Appellant has sought for posting roster of civilian employees. Even further, PIO has urged that there is no larger public interest in the disclosure of this information. PIO shall note that the aspect of larger public interest is decided only when it is established that information sought is exempt under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. It is irksome to note that Lt. Col. JS Brar, PIO has gone into the history of the service conduct of the Appellant to persecute his alleged habit of filing RTI Applications. The PIO has even gone to the extent of stating that since the mother of the Appellant has expired, the reason for which he applied for compassionate posting has become null and void, this by implication suggests that the PIO perhaps intends to apprise the bench that the information sought in the RTI Application is of no use to the Appellant now.
Commission finds the written submissions of Lt. Col. JS Brar, PIO to be in extremely bad taste and condemns his unwarranted remarks against the Appellant.
Lt. Col. JS Brar, PIO shall take strict note that under RTI Act, an applicant is not required to provide any reasons for seeking information, nor is the applicant expected to have a pristine service record to be eligible to access information. RTI Act bestows a statutory right which can be exercised by any citizen irrespective of his reasons, his allegiance to a government office, whatsoever. The PIO was only required to justify the denial of information under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of RTI Act, without making any submissions relevant to RTI Act, PIO has far stretched his limit.
Lt. Col. JS Brar, PIO is severely warned to exercise due caution in future in matters of RTI Act. Further, the denial of information under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. A compliance report to this effect shall be duly sent to the Commission by the PIO. The appeal is disposed of accordingly.
