Delay in informing the marks obtained in an examination

The appellant sought information regarding marks obtained by him in each paper of an examination. During the hearing, it transpired that this information was supplied to him after 05 months. The appellant submitted that the partial information was supplied beyond the prescribed period of 30 days and he now desied copies of the answer scripts.

The respondents submitted that answer scripts have since been destroyed as per rules. The Central Information Commission noted that the respondents however, have not been able to give any satisfactory explanation for delayed supply of information. Holding that the delay has caused detriment to the appellant for which he needs to be awarded suitable compensation, the Commission awarded compensation of Rs. 2,500/- to the appellant under section 19(8)(b) In its decision, the Central Information Commission or State Information Commission, as the case may be, has the power to require the public authority to compensate the complainant for any loss or other detriment suffered; of the RTI Act.
