Copy of note sheets with regard to action taken on appellant’s grievances was not provided despite FAA’s order - CIC: PIO to comply with the direction given by the FAA failing which action against him under the provisions of the RTI Act would be initiated

The appellant has sought the following information pertaining to his letter No. PF/SDM/Invt/1987/Mid/81 dated 6th February, 2019, written to the Secretary, MOSP, in connection with redressal of his grievance:
- Provide the copy of note sheets with regard to action taken on his several grievances, on matters pertaining to regularization, grant of ACP and MACP, inclusion in SSS and payment of arrears and other economic benefits.
Grounds for Second Appeal
The CPIO did not provide the desired information.
Submissions made by Appellant and Respondent during Hearing:
The appellant submitted that even though the FAA in his order had directed the CPIO to provide the relevant information to him, however, till date no information has been provided.
The CPIO submitted that an appropriate reply was given to the appellant on 30.04.2019.
Observations:
From a perusal of the relevant case records, it is noted that the FAA in his order had directed the CPIO to provide the action taken on the service matters of the appellant within 15 days from the date of the order
On a query to the CPIO as to whether any additional information was supplied to the appellant in compliance with the FAA’s order, he was unable to submit anything in this regard. Hence, in the absence of any record, the Commission holds that the FAA order has not been complied with by the CPIO till date. This is indeed an appalling situation.
The Commission expresses its extreme displeasure to see the irresponsible attitude of the concerned CPIO who has not even paid heed to his own FAA’s order and has in fact flouted the same.
Decision:
In view of the above, the CPIO is directed to comply with the direction given by the FAA in his order dated 24.05.2019 within 15 days from the date of receipt of the order under intimation to the Commission. He is directed to take immediate necessary action without any further delay, failing which the Commission will be constrained to initiate necessary action against him under the provisions of the RTI Act.
A warning is also issued to the CPIO for flouting the FAA’s order. He is directed to be careful in future with regard to the above observations.
The appeal is disposed of accordingly.
