The appellant has sought the following information:
1. Certified copies of the educational certificates submitted by the Principal and Teachers (part-time/temporary/permanent) appointed at Murari Kunj Saraswati Vidya Mandir Secondary School, Dhanghati, Goverdhan Dist., Mathura during 2016-17, 2017-18, 2018-19.
2. Copy of the documents submitted by Murari Kunj Saraswati Vidya Mandir Secondary School, Dhanghati, Goverdhan Dist., Mathura for getting recognition for class 11th and 12th.
3. Whether the above said school has got recognition for class 11th and 12th.
Grounds for Second Appeal
Both CPIO and FAA have not provided any reply.
Submissions made by Appellant and Respondent during Hearing:
The appellant submitted that no relevant reply was received by him. The CPIO submitted that unintentionally after providing an interim reply on points 2 and 3, a final reply could not be given in respect of these points of the RTI application. She requested for an opportunity for providing a final reply. The appellant also pressed for information in respect of point no. 1 of the RTI application.
Observations:
Based on a perusal of the record, it was noted that a final reply was not given in respect of points no. 2 and 3 of the RTI application. In respect of point no. 1 of the RTI application, the CPIO had correctly transferred the RTI application to the concerned State public authority u/s 6(3) of the RTI Act. In respect of points no. 2 and 3 of the RTI application, the CPIO shall provide a final reply.
Decision:
The CPIO is cautioned to be careful regarding the timelines prescribed under the Act to avoid penal proceedings u/s 20 of the RTI Act. She is directed to provide a final reply to the appellant as mentioned above within 10 days from the date of withdrawal of the lockdown. The appeal is disposed of accordingly
