1. The appellant filed an application dated 14.05.2013 under the RTI Act seeking copy of a complaint lodged by a particular person. CPIO responded on 13.06.2013 by denying information under section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Appellant filed first appeal with the first appellate authority (FAA) on 19.06.2013. FAA responded on 03.07.2013. Appellant filed this present appeal on 12.08.2013.

Hearing

2. Appellant and respondent were present before the Commission.

3. Appellant referred to the RTI application and stated that he was seeking copy of a complaint lodged by a particular person.

4. Appellant stated that the complainant who had lodged the complaint was his neighbour. Appellant stated that his neighbour had constructed an illegal shop, that in this regard there was a dispute, and that in this light he required a copy of the complaint filed by his neighbour.

5. Respondent stated that the information sought by the appellant was a third party information, and that the third party had submitted a letter with the respondent not to disclose copy of the complaint.

6. Respondent stated that the appellant and the complainant had lodged complaint against each other and that the complaint sought by the appellant was sensitive in nature.

7. The respondent CPIO’s letter of 13.06.2013 states that information has to be denied under section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. What the respondent stated in the hearing is at variance with the CPIO’s letter. The FAA by letter dated 03.07.2013 has said that the information sought has already been provided. The appellant said that no information has been provided. The respondent has not provided any convincing reason why the information sought in the RTI application of 14.05.2013 should not be provided.

Decision

8. Respondent is directed to provide to the appellant, within 30 days of this order, the information sought in the RTI application. The appeal is disposed of. Copy of decision be given free of cost to the parties.
