Copy of the bank loan application of son under RTI

The appellant was the father of the person who had applied for a loan from Dena Bank under the PM’s Rozgar Yojana scheme for setting up a readymade garments unit. He sought various information related to the loan of his son. The Public Information Officer (PIO) gave partial information and denied the information related to the loan application of the appellant’s son under section 8(1)(e).

The respondent submitted that they had provided all the information as per the record except loan related information as the information of the customer’s with the Bank was held in a fiduciary capacity and hence cannot be disclosed to the third party under section 8(1) (e) of the RTI Act. The Central Information Commission upheld the PIO’s decision and rejected the appeal.
