ORDER
The present appeal, filed by Shri Onkar Singh against Unique Identification Authority of India, was taken up for hearing on 06.01.2014 when the Respondents were present through Shri Shrish Kumar, ADG and Shri Upendra Sharma, Dy. Director. The Appellant was, however, not present.

The Appellant through an RTI application dated 25.02.2013, filed before the CPIO, Unique Identification Authority of India, New Delhi, wanted to obtain copy of application form along with copies of documents submitted with it by one Smt. Maya for issuance of Aadhaar Card (bearing No. 3932 1909 3549).

The CPIO vide his letter dated 01.03.2013 declined the disclosure of information to the Appellant citing exemption u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. 4. On receipt of this reply, the Appellant made another application dated 09.03.2013 to the CPIO alleging that Smt. Maya had wrongfully used his (Appellant’s) name in place of her husband’s name in the Aadhaar Card issued to her. He thus requested that copies of documents enclosed with the application form submitted for issuance of said Aadhaar card be made available to him so that he could submit the correct documents to the UIDAI in order to correct the mistake in said Aadhaar Card.

The CPIO, however, once again by his letter dated 26.03.2013 denied the information to the Appellant u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. 6. Aggrieved by the CPIO’s reply, the Appellant filed the instant appeal before the Commission challenging the denial of information by the Respondents.
7. Heard submissions.

The Commission concurs with the Respondents’ view that information sought by the Appellant here relates to personal information of the third party, disclosure of which would cause unwarranted invasion of the privacy of the third party. Such category of information attracts exemption section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. The Appellant has also not established any larger public interest warranting the disclosure of this information. Therefore no disclosure can be allowed in respect of the present RTI application. However, given the nature of the allegations leveled by the Appellant in his second application dated 09.03.2013, this matter needs a separate examination /enquiry by the public authority under the existing rule/norms/guidelines/mechanism they are following. Considering this the CPIO is hereby directed to apprise the Appellant of such rule/norms/guidelines/mechanism under which his allegations/complaint can be looked into by the public authority. The CPIO may do so within 1 week of receipt of this order.
9. Appeal is disposed of with the above directions.
