Compensation against misleading the CIC

The appellant submits that the Admin. Officer of the Jhansi Cantonment Board misled the Commission in the last hearing held on 07.06.2011 in which he claimed that the Cantonment Board had obtained a stay on the order dated 19.3.1993 passed by ADJ, Jhansi. The Appellant claimed that no superior court has granted any stay on the ADJ’s order and hence the Admin Officer has deliberately and intentionally misled the Commission and thereby caused detriment to the appellant in terms of Section 19(8) (b) of the RTI Act.

The CIC found that the respondent did not have any viable explanation to submit in the matter. Hence, the Commission ordered the Cantonment Board to pay a compensation of Rs. 3,000/- to the appellant under section 19(8)(b) In its decision, the Central Information Commission or State Information Commission, as the case may be, has the power to require the public authority to compensate the complainant for any loss or other detriment suffered; of the RTI Act .
