The complainant has stated that Mr. Satpal Singh Sandhu had filed RTI application dated 28/04/2021 for inspection of files related to Bungalow No.16 & 24, situated at Faizabad Cantt, UP, through his authorised representative. CPIO vide letter dated 03/06/2021, intimated Mr. Sandhu that he can send his authorised rep. to inspect the said files in the last week of July, 2021. Mr. Sandhu authorised Mr. Prem Kumar Singh and Mr. Anil Bakshi to inspect the said files.
Accordingly, Mr. Prem Kumar Singh visited the office of CPIO, Mr. Mohd. Arif on 26th July, 2021, but the desired inspection of the said files was not provided. In the said context, the complainant has sought the following information:
- Issue necessary Orders to the CPIO for providing complete inspection of the files pertaining to Bungalow No. 16 and 24 situated at Faizabad Cantt. (UP).
Grounds for filing Complaint
The CPIO did not provide the desired inspection of the files.
Submissions made by Complainant and Respondent during Hearing:
The representative of Prem Kumar Singh was present for the hearing, but had failed to send the authority letter in advance of the hearing.
The CPIO was informed that the present complaint is not maintainable.
Observations:
At the outset, the Commission observed that the present complaint is not admissible. The complainant has no onus in filing this complaint as the RTI application was not filed by him but Col (Retd) Satpal Singh Sandhu. Therefore, the Commission finds no ground to admit this complaint.
Decision:
The RTI applicant is at liberty to file a fresh complaint in his name and seek condonation of delay, citing the present order.
The appeal is disposed of accordingly
