The Complainant sought information through 5 points regarding the contractors hired for outsourcing staff; details of sanctioned strength of staff and vacancies; name of outsourced employees; prevalent directives of CEO on mode of payment of salary to outsourced employees.

In view of this, Commission directs Kulwinder Singh, the then CPIO & Accountant through the First Appellate Authority to appear before the bench on 16.11.2018 at 11.30 am via videoconferencing (venue of hearing will be intimated separately) to show cause as to why action should not be initiated against him/her under Section 20 of the RTI Act. Kulwinder Singh, the then CPIO & Accountant is also directed to send copy of all supporting documents upon which he chooses to rely upon during the hearing to the Commission. CPIO shall send the copy of said documents to the Commission atleast two days prior to the hearing via email.

A copy of this order is marked to the First Appellate Authority/Chief Executive Officer to ensure compliance of above directions by the concerned then CPIO. Registry attached to this bench is directed to schedule a video conferencing slot for the aforesaid date & time and issue the notice of hearing to the abovesaid then CPIO through the FAA.

Proceedings of Final Decision:

Commission received a request from Kulwinder Singh, the then CPIO & Accountant vide email on 30.10.2018 to adjourn the show-cause hearing scheduled on 16.11.2018 due to some family function. The said CPIO has submitted that since Appellant sought for documents submitted by the outsourcing agencies which includes details like PAN No., TAN No., Account No. and financial statements of third parties, he denied the information under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. The then CPIO has clearly failed to peruse the contents of the RTI Application as nowhere has the Complainant sought for PAN No., TAN No., Account No. and financial statements of third parties, even if by farthest stretch of imagination it is presumed that details of tender application sought at para 1 of the instant RTI Application includes these averred personal details, it was incumbent on the CPIO to have provided the name of the agency and details of contract/agreement entered into with the agency, in other words, only part of the information sought at para 1 of the RTI Application could have been exempted under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. The earlier decisions of the Commission referred by the CPIO are not even in the context of the information sought in the instant RTI Application.

Commission is irked by the sheer display of ignorance and callousness in the conduct of Kulwinder Singh, the then CPIO & Accountant while dealing with the RTI Application. Commission drops the show-cause proceedings for want of any material on record to show that the denial of information was deliberate and/or malafide. However, Commission expresses severe displeasure against Kulwinder Singh, the then CPIO & Accountant and warns him to remain careful in future. The Complaint is disposed of accordingly.
