Can a third party seek a copy of the enquiry report?

A government employee lodged a complaint at the Department’s website. As the matter related to the Office of Post Master General, Allahabad, the complaint was transferred to him. The appellant’s request for a copy of enquiry report in-connection with that complaint was rejected by the Public Information Officer (PIO) claiming it was third party information.

The Central Information Commission agreed that a third party cannot seek a copy of the enquiry report and dismissed the appeal. However, the Commission observed that if the Office of Post Master General, Allahabad receives a request for the copy of enquiry report directly from the government employee who had filed the complaint, the same should be supplied if it exists.
