Bidding process seen in NIC portal should not be shown to competing bidders
Ref: Copies of the purchase orders placed & bills received from a supplier; certified statement of all the payments made by SBI & details of services provided by that vendor were denied u/s 8(1)(d) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm the competitive position of a third party, unless the competent authority is satisfied that larger public interest warrants the disclosure of such information; - CIC: provide certified copy of the contract to the appellant
Many bidders just try to sneak into details through Purchase Orders which are having Login and password. I agree that the Information as in this case is third party information and should be disallowed by PIO. These are not public information and can be used by competitors in commercial way.
Even the bidding process should not show these orders as presently seen in NIC portal by competing bidders as it defeats the purpose of tendering on technical opening. The bids should be visible only to opener and not others. Evaluation can be presented after approval.
