Information sought:
The appellant sought information regarding action taken on her complaint dated 21.06.2014 against Dr. Santhosh Kalapurayil along with copy of video CD/photograph of Dr. Santhosh Kalapurayil regarding the screening test conducted at Delhi on 25.10.2011.
Relevant facts emerging during hearing:
Both parties are present and heard through video conferencing. The appellant filed RTI application on 30.06.2014, seeking the above information. CPIO in his reply informed the appellant that the matter is under investigation. The FAA did not dispose of the first appeal. The appellant stated that information sought for related with a person who will be dealing with life of human beings as a physician (Doctor). She stated that the same person has been unauthorisedly practicing as a doctor from 2004 and life of many people are likely to be endangered. The appellant alleged that through impersonation, the said doctor appeared in the Screening Test conducted by the National Board of Examination and is now trying to obtain permanent registration from MCI. He alleged that some other person appeared in the exam on behalf of Dr. Santosh and requested for a copy of the video recording which was taken during the examination.
The respondent stated that they have launched full-fledged investigation and during the course of investigation, NBE has called Mr. Santoh Kalapurayil for personal appearance and has verified all documents afresh. He stated that NBE has not been able to find any discrepancy. He further stated that in video recording also, he is the same person who had appeared for the exam.
Decision:-
After hearing both the parties and on perusal of record, the Commission finds that National Board of Examination have given their authoritative version before the Commission that they have called the person and matched with the video recording and confirmed that Dr. Santosh Kalapurayil is the same person who appeared for the exam. The Commission directs that the respondent authority shall intimate the outcome of their enquiry to the appellant within 2 weeks of the receipt of this order, under intimation to the Commission. The appellant has filed one complaint bearing no. CIC/YA/C/2015/900260 on the same issue, the same is being disposed of vide this order. The appeals/complaint are disposed of accordingly.
