According to the appeal, the Appellant filed an RTI application on 2.3.2013 seeking information as to whether Potassium Chloride Technical grade IS4150 used by industries would fall under Fertilizer Control Order. The CPIO responded on 2.4.2013, stating that the Public Authority had incorporated Potassium Chloride (MOP) in Schedule I part A of Fertilizer (Control) Order, 1985 as Potassic Fertilizer. He further stated that the Public Authority had no record available in regard to “Potassium Chloride IS Potassium Chloride technical 4150”. Not satisfied with the reply of the CPIO, the Appellant filed an appeal to the First Appellate Authority on 17.4.2013. In his order dated 13.5.2013, the FAA informed the Appellant that the Public Authority had given information available with it and no further information was available to be provided. Aggrieved with the order of the FAA, the Appellant approached the CIC in second appeal on 21.5.2013.
2. We heard the submissions of the Appellant and the Respondents. The Appellant submitted that the Respondents should tell him whether or not Potassium Chloride Technical Grade IS4150 used by industries would fall under Fertilizer Control Order. The Respondents submitted that no information on the above was available on their record. They further submitted that such information as was available on their record had already been conveyed through the CPIO’s reply dated 2.4.2013 and FAA’s order dated 13.5.2013. Having considered carefully the submissions made before us, we are satisfied that the Respondents have responded to the RTI application in keeping with the provisions of the RTI Act, 2005 and no further action is pending on it.
3. With the above observation, the appeal is disposed of.
