Appellant contented that respondent has given wrong information that Mr KS Yadav is teaching in the school - Respondent: there is a personal rivalry between the appellant & Mr KS Yadav - CIC: clarify the discrepancy & furnish a copy of the enquiry report

FACTS

The appellant Mr. Ajay is present along with one Mr. Satyapal. The Public Authority is represented by Mr. Marcel Ekka, Dy. Director (West A), Dte. Of Education, GNCTD, Delhi.

2. The appellant submitted that he is seeking information through his RTI application dated 22-6-2012 regarding one Mr. K.S.Yadav, TGT (Natural Science) posted at Govt. Sarvodaya Bal Vidhyala, Ramesh Nagar, New Delhi. The appellant’s contention is that Mr. KS Yadav, TGT (Natural Science) is not teaching in the School, but the respondent has given wrong information that he is teaching in the school. The appellant further submitted that there is discrepancy in the two Time Tables furnished by the respondent for the academic year 20122013. The appellant also submitted that information on points 2 to 7, 11 and 12 of his RTI application has not been furnished by the respondent.

The respondent submitted that they have supplied all the information to the appellant as per the FAA order dt. 22-8-2012, except on points 8, 10, 13 and 14 of his RTI application which are in the nature of queries and merit no reply under section 2(f) “information” means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force; of the Act. The respondent has presented a copy of the letter dt. 30-8-2012 containing all the information sought by the appellant, to the Commission and to the appellant during hearing today. The Respondent also submitted that there is a personal rivalry between the appellant and Mr. K.S.Yadav and the appellant made a number of complaints against him which are rejected by various Departments. The respondent also submitted that the police enquiry and the departmental enquiry against Mr. K.S. Yadav did not prove any allegation made by the appellant against him.

After hearing the submissions made by the appellant and the Public Authority, the Commission directs the respondent authority to clarify the discrepancy pointed out by the appellant, between the 2 time tables for the academic year 20-12-2013 and also to furnish a copy of the enquiry report submitted by the police/department, to the appellant regarding Mr. K.S. Yadav within one week from the date of receipt of this order.

5. The case is disposed of accordingly.
