Should income tax returns of elected representatives be made public?

Former Information Commissioner at the Central Information Commission (CIC) Shailesh Gandhi has filed a petition with the Bombay High Court to quash an order of the CIC rejecting his appeal to furnish copies of income tax returns of Maharashtra Deputy Chief Minister Ajit Pawar, who is also a senior NCP leader and nephew of Union Minister Sharad Pawar.
Earlier Gandhi had filed an application under the RTI Act with the Public Information Officer (PIO) of Income Tax department on November 21, 2012 seeking copies of income tax returns of Ajit Pawar. The PIO issued a notice to Ajit Pawar under section 11 and in reply, who opposed the disclosure of any information. The PIO denied the information on the ground that it relates to a third party having no relationship to any public activity or interest and, therefore, it could not be supplied under provisions of Section 8(1)(j)
Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information:
Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person.

Gandhi filed an appeal before the first Appellate Authority (FAA) alleging that section 8(1)(j)

would not be applicable in this case as the information as the information sought for formed part of public activity. He argued that PIO of income tax department had failed to properly examine the proviso to section 8(1) of RTI Act i.e., information which cannot be denied to Parliament or a State Legislature shall not be denied to any person. He also asserted that exemption under Section 8(1)(j)

cannot be claimed since Pawar was an elected representative and was answerable to people in view of the Supreme Court's ruling. He alleged that disclosure of his income would be in larger public interest. His appeal was rejected by the FAA and the matter came up before the CIC.
The petition is likely to come up before the High Court for hearing on October 22.
