Seeking remedy for personal grievance through RTI

Background
The appellant sought the reasons for the delay in fixing the exam date for change of category of his post by the Railway Board. He also wanted to know the reason why he has not got the category change to ‘constable’ from his present post of ‘follower' even though he has passed Matric and has been working on the same post for 8 years. The Public Information Officer (PIO) informed the appellant that because of the large number of vacancies, the proposed selection could not be held.

During the hearing the appellant submitted that the category change ought to have taken place as per rules after five years of service. He also requested the Commission to direct the Public Authority to promote him to the senior grade since he had completed five years of service. The Commission rejected the appeal stating that the details sought by the appellant were not available with the Public Authority. The Commission further observed that the relief sought by the appellant cannot be granted since the same falls outside the ambit of the RTI Act.
Comments
Such service grievance are common and perhaps the best way to deal with such cases to is ask for the norms for post change, the name of the individual responsible for enforcing the same, the punishment which can be awarded for the lapse and whether any action has been taken for lapse.
