Seeking the basis on which the name of father had been corrected in Birth Certificate - PIO: no documents available - CIC provide the relevant rules under which the correction was made and the records on the basis of which the name has been corrected

1. The appellant through his RTI application dated 13.1.2012 requests to know the basis on which the name of the father had been corrected in the Birth Certificate of the child including the records on the basis of which the name was changed. The case in brief is that the appellant and his wife Smt. Brindhavathy had got divorced. After a period of one year of divorce a child was born to appellant’s former wife. The birth took place Maternity Hospital, Puducherry. While in the records of Maternity Hospital, the birth certificate mentioned the father’s name as Sivaprakasam. The Puducherry Municipality had changed the name of the appellant as father in the birth certificate after one year of child’s birth. The appellant wants to know the basis on which such correction was made. The PIO vide letter No. 316/PM/OM/RTI/2012 dated 31.1.2012 informed the appellant that his RTI application was sent to Registrar of Birth and Deaths Section to ascertain the basis on which the birth had been registered giving the appellant’s name as the father of the child. It was clear that as per Birth report of the Maternity Hospital, Puducherry, the birth event was duly registered vide Registration No. M/2006/02474. Further it was informed to the appellant that there is no documents available regarding the change of name i.e. the basis on which the father’s name was changed on 2.3.2007.
2. Aggrieved with reply of the PIO, the appellant filed first appeal on 8.2.2012 before the FAA. The FAA vide order No. 1757/DIR/LAD/PA/2012-RTI dated 28.3.2012 recorded that the PIO has furnished reply to five questions and the other five questions have not been replied to. The FAA directed the PIO to furnish necessary replies to other five questions within fifteen days.
3. The appellant states during the hearing that no proper reply has been given to him by the respondent to his query about the basis/records on the basis of which, the name of child’s father has been changed in the birth certificate.

Having considered the submissions of the parties, the Commission hereby directs the PIO to inform the appellant of the relevant rules under which the correction has been made in the birth certificate as well as the reasons/documents/records on the basis of which the name of the father has been corrected in the birth certificate. The PIO will also provide the appellant certified copies of entire records/note sheets/correspondence regarding this matter including a copy of his order recording the change of father’s name in the birth certificate of the child. In case, the appellant so desires, the PIO will also provide opportunity to the appellant for inspection of relevant records and provide photocopies of the documents identified by the appellant free of cost. The PIO will comply with the directions of the Commission within two weeks of receipt of this order. The matter is disposed of on the part of the Commission with above directions.
