Rules and regulations in respect of refugees from Pakistan - CIC: PIO to provide an elaborate reply regarding rules under which the Pakistani nationals are allowed to stay in India and the facilities they can enjoy during their stay in India

1. The appellant through his RTI application dated Nil sought information on eleven queries seeking rules and regulations in respect of refugees for the persons migrated from Pakistan; the facilities availed by such refugees including allotment of plots etc. to Sindhi migrants at Udaipur. The CPIO (F-IV), MHA vide letter No. 25022/12/2012-F-IV dated 29.6.2012 replied to the appellant on Point No. (A), (B) and (D) of the RTI application stating that there are no Rules and Regulations framed by the Government of India in respect of refugees, hence the information may be treated as ‘Nil’. The CPIO, FFR Division, MHA replied to the appellant on Point No. C, E, F, G, H, I, J and K that no such information is available with FFR Division of MHA.
2. The FAA, before whom the appellant filed first appeal, vide his order No. 36/04/2011-R&SO dated 14.8.2012 concurred with the reply of the CPIO.
3. Having considered the submissions of the parties, the Commission hereby directs the CPIO to provide an elaborate reply regarding Rules and Regulations under which the Pakistani nationals are allowed to stay in India and the facilities do they enjoy during their stay in India. The CPIO will comply with the directions of the Commission within two weeks of receipt of this order. The matter is disposed of on the part of the Commission with above directions.
