The provisions of this Act shall have effect notwithstanding anything inconsistent therewith contained in the Official Secrets Act, 1923 (19 of 1923), and any other law for the time being in force or in any instrument having effect by virtue of any law other than this Act. May 2012 of Hon’ble Mr. Surinder Awasthi, State Information Commissioner, Punjab in the Appeal Case No. AC-572 of 2012.
In the Writ Petition No. 12804 of 2012 heard on August 01, 2013 in the case titled Parbodh Chander Bali v. State of Punjab and others (the State Information Commission, Punjab is Respondent No. 1 and SSP, Cyber Cell, Mohali is Respondent No. 2), the Hon’ble Punjab & Haryana High Court Chandigarh slapped a cost of Rs. 10,000/- on SSP, Cyber Cell, (Mohali) Punjab for the delay in filing the reply. In the order, Justice Ajay Tewari noted that the notice of motion was issued more than one year ago no reply has been filed on behalf of respondent No. 2 till date. The bench ruled that in the circumstances, there is no justification for granting any further time to respondent No.2. However, at the persistent request of learned Addl. AG, the bench granted four weeks’ time to respondent No.2 to file reply along with costs of Rs.10,000/- to be paid personally by the respondent No.2 in the form of draft in favour of the petitioner.
The case is to come up next on September 03, 2013.
