14 Jan, 2015The appellant is not present. The Public Authority is represented by Ms. Saroj Achra, Principal along with one official from Salwan Boys Senior Secondary School, New Delhi.
FACTS:
2. Appellant through his RTI application dated 12082013 had sought information on 4 Points Viz i) Particulars of the student participated in all india Under16 Cocacola tournment ii) record of the tournament fee paid and winning prize amount iii) Photocopy of Class attendance register of class 9A 201314, etc. PIO responded on 11092013. Being unsatisfied with the information provided, the appellant preferred First Appeal and the order CIC/SA/A/2014/000193 Page 1 of FAA is not available on the file. Claiming nonsatisfaction with the information provided, the appellant preferred Second Appeal before the Commission.
Decision:
3. The respondent officers made their submissions. The appellant is not present. The respondent officers submitted that the appellant Mr. L.K.Jha is a teacher of the respondent/school and most of the questions on which he is seeking information pertain to the students of his own class. The PIO/Principal of the School submitted that the appellant, being a teacher of their school, the entire information sought by him is available with himself. The Commission observes that the appellant being the teacher of the respondent school, must be knowing all the information which he sought. He is not present for hearing today, to let the Commission know, what information is not available with him. From the reading of his RTI application, the Commission finds that there is no public interest to be served by disclosing this information and most of the information sought is personal information of the students, copies of which cannot be given straightaway, unless the objections from the ‘third party’ are invited. Hence the Commission, having come to the conclusion that the appeal is devoid of any merit/public interest, closes the appeal.
